🔴 Why This Project Has Not Started

The site at 2121 North Bayshore Drive still holds Biscayne 21, a 1964 condominium building that The Real Deal described on 3 September 2026 as vacant and still standing. To build the EDITION tower, Two Roads had to terminate that condominium and buy out its owners. It paid about $150 million in 2022 for the majority of the units (The Real Deal, 31 August 2026), and a group of owners who did not sell sued in 2023.

The owners alleged that the developer-controlled association illegally lowered the termination threshold from 100 percent to 80 percent of owners. The Third District Court of Appeal reversed a lower-court ruling in March 2024, and on 10 July 2025 it denied Two Roads’ request for a rehearing, finding that the amendment altered the owners’ voting rights (The Real Deal, 10 July 2025). The Florida Supreme Court declined to review the case in October 2025 (The Real Deal, 16 October 2025). The Real Deal reported on 14 March 2024 that attorneys said the appellate ruling had implications for condominium terminations across Florida.

A Miami-Dade court order entered on 12 January 2026 required TRD Biscayne, the Two Roads entity, to restore the condominium association and undo the termination, to turn the utilities back on and to repair and maintain the building to the condition it was in when the suit was filed in May 2023, and it barred the developer from seeking zoning approvals or demolition permits; Two Roads said it would comply with all court orders (The Real Deal, 14 January 2026). Two Roads’ affiliate filed its own complaint at the end of January asking the court for equitable relief that included terminating the association (The Real Deal, 8 February 2026), and The Real Deal reported on 14 May 2026 that a certificate of termination had been filed in April.

On 31 August 2026 The Real Deal reported that Two Roads had settled with the holdout owners and paid them for their units, with a court still to sign off on the resolution. The developer’s announcement did not give the price (Florida YIMBY, 2 September 2026); The Real Deal cited a source at about $50 million, and Bisnow and Commercial Observer reported $50 million.

Separately, The Real Deal reported on 14 May 2026 that three buyers had sued Two Roads in Miami-Dade Circuit Court, in a suit filed in April 2026, to recover deposits of about $2.5 million, plus interest, costs and attorneys’ fees, on contracts for five units signed in spring 2023. As The Real Deal describes it, the complaint alleges that the developer has anticipatorily breached the contracts because it is impossible to substantially complete construction by about 20 June 2028; Two Roads said the claims are “without merit” and that it expected the suit to be resolved through summary judgment. The Real Deal’s timeline of 3 September 2026 added that on 21 July the judge denied the buyers’ motion to enforce a settlement agreement and that a hearing on Two Roads’ motion to dismiss was set for later that month. I have not found a report of the outcome.

Construction of the tower has not started. The developer told The Real Deal on 31 August that demolition of the existing building could begin in a few weeks; Bisnow (1 September) reported a plan to demolish within two to three weeks, and Commercial Observer (2 September) reported demolition planned for September. I have not found a report, as of 24 September 2026, that demolition has begun.

The Miami-Dade Property Appraiser (retrieved 24 September 2026) lists 192 folios at 2121 North Bayshore Drive under “Biscayne 21 Condo”: 191 unit folios plus a reference folio, every unit with a 1964 year built. The unit folios carry the legal-description note “REINS OF BISCAYNE 21 CONDO PER ORDER ON PLAINTIFFS’ OMNIBUS MOTION FOR RELIEF CASE# 2023-016774-CA-01”, the reference folio also lists a “PLAN OF TERMINATION” recorded at OR book 33480, page 4758, and no sale after October 2022 appears on any folio. I have not found a source that explains how those entries relate.

What This Means If You Have a Deposit In

This is not legal advice. The holdout-owner suit was reported settled on 31 August 2026; the buyers’ deposit suit is pending. If you are holding a contract here, these are the questions I would put to the developer, with the answers in writing and checked against your contract and the offering documents:

  • Where is your deposit held and under what escrow terms? Three buyers have sued to recover theirs (The Real Deal, 14 May 2026).
  • What is your outside date, and what happens when it passes? Three buyers’ contracts described by The Real Deal expected completion by summer 2028, and construction had not started as of 24 September 2026.
  • What does your contract say if a completion date is missed?
  • What is the current status of the court’s sign-off on the settlement and of the demolition permit? I have not found either reported as complete as of 24 September 2026.

The Real Deal reported on 31 August 2026 that Two Roads Development settled with the holdout owners of the existing Biscayne 21 condominium on the site, with a court still to sign off on the resolution, and the developer said demolition of the existing building could begin in a few weeks. Construction of the tower has not started, and I have not found a report that demolition has begun as of 24 September 2026. Separately, three buyers have sued Two Roads for the return of about $2.5 million in deposits (The Real Deal, 14 May 2026; the suit is pending). Has EDITION Residences Miami Edgewater broken ground?

No. On 31 August 2026 The Real Deal reported that Two Roads Development had settled with the holdout owners at Biscayne 21, the existing condominium on the site, and that a court still had to sign off on the resolution. The developer told The Real Deal that demolition of the existing building could begin in a few weeks. I have not found a report, as of 24 September 2026, that demolition has started.

What was actually holding the project up?

A condominium termination fight. Two Roads paid about $150 million in 2022 for the majority of units at Biscayne 21 — a 13-storey, 192-unit bayfront building at 2121 North Bayshore Drive — financed with a $45 million mezzanine loan from Lionheart Strategic Management and a $105 million senior mortgage from Bank OZK (The Real Deal, 16 October 2025). Holdout owners sued in 2023, arguing the developer-controlled association acted illegally when it lowered the threshold for terminating the association from 100% of owners to 80%. Florida’s Third District Court of Appeal ruled for the owners, and the Florida Supreme Court declined to hear the case in October 2025, which The Real Deal described on 31 August 2026 as leaving the developer no further legal options.

Why did the developer lose that argument?

According to The Real Deal (31 August 2026), Biscayne 21’s declaration lacked what is known as “Kaufman language” — the phrase “as amended from time to time”, which applies later changes in state law to a condominium declaration automatically. Without it, the appeals court’s opinion held that lowering the termination threshold from 100% to 80% would have required 100% of the unit owners to agree. That wording, or its absence, is in the building’s recorded declaration.

How was it settled?

The developer paid the holdouts for their units. Two Roads’ announcement did not give the price (Florida YIMBY, 2 September 2026), and its co-founder declined to disclose it to The Real Deal, which cited a source at about $50 million (31 August 2026). Bisnow (1 September) and Commercial Observer (2 September, citing a Two Roads representative) reported $50 million. The Real Deal reported that the resolution closed on Monday 31 August 2026 and that a court still has to sign off on it, and that the deeds had not been recorded as of 3 September.

Is there any other litigation on this project?

Yes. The Real Deal reported on 14 May 2026 that three buyers had sued Two Roads in Miami-Dade Circuit Court to recover deposits of about $2.5 million, plus interest, costs and attorneys’ fees, on contracts for five units; the suit was filed in April 2026. The Real Deal reported on 3 September 2026 that a hearing on the developer’s motion to dismiss was set for later that month; I have not found a report of the outcome.

Can I buy at EDITION Residences now?

Two Roads co-founder Taylor Collins told The Real Deal on 31 August 2026 that presales have been slow and that the developer plans to reopen the sales center in October or November, expecting the end of the litigation to bring back buyers who had been waiting. Commercial Observer reported on 2 September 2026 that the project is about 40% pre-sold; the article does not say where the figure comes from. The Douglas Elliman project page reads “Pricing upon request” (read 24 September 2026).

When will it be completed?

I have not found a completion date published by the developer or in the trade press. Three buyers’ contracts described by The Real Deal (14 May 2026) expected units completed by summer 2028. At the September 2022 launch the developer expected to break ground in summer 2023 and deliver about 36 months later (Florida YIMBY, 16 September 2022). Confirm the delivery date and the outside date in your own contract and the offering documents.

What is planned?

185 residences across 55 storeys at 2121 North Bayshore Drive on the Edgewater bayfront — the first of three planned towers — by Two Roads Development, with architecture by Arquitectonica and interiors by Studio Munge, priced from $1.7 million on the developer’s project page. EDITION is a Marriott International brand, and EDITION Hotels is slated to manage and operate the residential development. Two Roads co-founder Taylor Collins told The Real Deal that the project moves forward as designed, with a longevity and wellness component and expanded food and beverage offerings.
